    Man who won land grabbing case against Ruto passes away

    An old man who won a case against Deputy President William Ruto over grabbed parcel of land has died at 86.

    Gilbert Muteshi dragged the DP to court on grabbing claims breathed his last on Tuesday October 27 morning.

    An obituary which this desk has seen and published by the Daily Nation confirmed that the former East African Airways Manager died in Nairobi with his family still holding on what led to his death apart from old age.

    Former Kakamega Senator Boni Khalwale was among the first leaders who visited the diseased’s Nairobi home saying he was saddened with the death of a man he looked upon as far as leadership was concerned.

    “Kakamega’s illustrious preindependence son, Adrian Muteshi is dead. He was the H/R Manager of the East African Airways before going into private consultancy. I spent this morning at his Nairobi home with his 85 year old widow who was also my teacher at Malinya Pr Sch. RIP kuka,” Khalwale tweeted.

    Muteshi, a Post-Election Violence PEV victim shot to limelight in 2013 when he won a case against Mr. Ruto who was ordered to pay him sh 5 million for occupying his land.

    According to court papers, Mr. Gilbert Adrian Muteshi mentioned that Ruto had plotted to grab his 100-acre farm in Uasin Gishu County when PEV was affecting the country. At the time Muteshi had fled the area due to hostility.

    Making a ruling over the matter, High Court’s Judge Rose Ougo ruled that the complainant had proved beyond reasonable doubts that the said land was his.

    “I can only attribute the irregular acts to Hosea Ruto (Mr Ruto’s witness) as honourable Ruto chose not to testify,” Justice Ougo ruled.

    On the other hand, Mr. Ruto through his proxy told Ougo that he was an innocent buyer who went for the piece of land after he heard rumours about it being on sale.

    He further defended that he had conducted due diligence before buying and therefore he ought to be given the land which had already been subdivided

    By the time this was happening, Mr. Ruto was also set to start his ICC case alongside President Uhurtu Kenyatta.
