    Two found guilty, one acquitted over September terror attack

    Two Al-shabaab suspects linked to Nairobi’s Westgate terror attack that happened on September 21, 2013 have been found guilty.

    Issuing a ruling today Wednesday October 7th, Magistrate Francis Andayi of Milimani Court found the two liable for the crime.

    Mohammed Abdul alongside Hussein Mustafa failed through their lawyers to disapprove the fact that they were part of plotters at the city Mall which claimed a total of 67 lives leaving more than 150 others with serious/permanent injuries.

    The Magistrate however found the second accused person Laban Abdullah Omar saying all the charges leveled against him were not convincing enough.

    Mustafa, Abdul and Abdullah Omar were facing a total of 12 counts related to commission of Terror activities, conspiracy to commits terrosrism, supporting terrorists and also being in the country illegally.

    Homenews.co.ke however learnt that Magistrate Andayi dismissed some of the counts which the prosecution had lined up against the suspects.

    The prosecution however, managed to convince the court to hold on to sentencing of those found guilty so that to allow victims of the attack to pen statements arguing that this will help a great deal in informing the basis upon which the sentence will rely upon.
